The Worst Drug, Inc., its subsidiaries, and/or affiliated companies (“TWD”, “we”, and/or “us”) respect the privacy rights of our users and provide this Privacy Policy to help you understand how we collect, store, use, and disclose information on our applications, products, websites, forums, and various API services and other services that we may offer from time to time (collectively, the “Service”).

Acceptance and Consent

By using the Service, you agree to the terms and conditions of this Privacy Policy and you consent to the collection, use, and disclosure of your information by us in accordance with the terms and conditions of this Policy. If you do not agree to the terms and conditions of this Policy, please do not provide us with any information and do not use the Service.

Changes to the Privacy Policy

We reserve the right, at our sole discretion, to change or modify this Privacy Policy at any time by posting the changed or modified version on our Service. Any such change or modification will be effective immediately upon posting. If you continue to access and/or use the Service including Services available through any third party platform or social networking site (“SNS”) after the effective date of any change, then such access and/or use will be deemed an acceptance of and an agreement to follow and be bound by the Policy as changed. The revised Policy supersedes all previous Privacy Policies. For this reason, we encourage you to review this Policy any time that you access and/or use the Service. Upon our request, you agree to accept or sign a non-electronic version of this Policy and any other policies or agreements set forth or available on or through the Service or any third party platform.

Information Collection and Use

Our primary goals in collecting and using information are to provide and improve the Service, to administer and to assist you in administering your Account on the Service, and to provide you with a better experience with the Service.

Personal Information and Non-Personal Information

Personal Information is information that specifically identifies an individual, including (but not limited to) full names, phone numbers, profile pictures or their URLs, email addresses, physical locations or the physical locations of users’ access devices, groups joined on third party platforms, and credit card or other billing information. By voluntarily providing us with personally identifiable data (“Personal Information”) and other information, you are consenting to our use of it in accordance with this Privacy Policy and as allowed by the terms of third party platforms. If you provide Personal Information, you acknowledge and agree that such Personal Information may be transferred from your current location to TWD and the authorized third parties herein. Your agreement takes place when you accept or allow one of our applications on a third party platform and you may choose not to allow the third party platform to provide us with certain information about you, but you might not be able to use certain features of our Service. This Privacy Policy in no way limits or restricts our collection of aggregate or anonymous information. In this Policy, we refer to all information collected from or about you, including personal information and non-personal information, as “Your Information.”

We may also request and collect Your Information when you administer or personalize your Account after registration or otherwise interact with the Service. For example, we may collect Your Information both when you enter promotions on or in connection with the Service as well as in connection with your transactions (such as (but not limited to) donations or the purchase of products) through the Service or with TWD’s advertisers. Such transaction-related information may include payment information such as information regarding your account with an online payment service provider, and information about your use of products and services offered by our advertisers.

Use of Applications

When you launch any of our applications, we collect information regarding your device type, operating system and version, carrier provider, IP address, Media Access Control (MAC) address, International Equipment Mobile ID (IMEI), and the device’s geo-location, language settings, and unique device ID. In addition, we create a unique user ID to track your use of our Service. This unique user ID is stored in connection with your Account profile information to enable us to move Your Information to a new device at your request. We may collect Your Information such as your name or email address from third party websites or other sources from which you download or access our applications, services, or products that also make up part of the Service.

Sweepstakes, Promotions, and Surveys

From time to time, we may ask you to complete a survey, participate in our loyalty programs, and/or offer you the opportunity to participate in Promotions (as defined in the Terms of Service) via the Service or through a third party platform. If you choose to participate in a Promotion, we will collect and store the information that you provide in connection with your participation in the Promotion such as your name, user ID number, email address, date of birth, phone number, and whatever other information you provide, and we will use and/or disclose that information in accordance with this Privacy Policy unless stated otherwise such as in the official rules of the Promotion or as stated in another privacy policy that may govern the Promotion. All of our Promotions are intended for people who are the age of majority in their respective state, province, or country unless otherwise expressly stated. In all cases where required, Promotions will have official rules or guidelines that outline what information is being collected or users will be directed to the most recent version of this Policy. In some cases, the information collected will be used only to administer the Promotion; in other cases, the information collected will be used for TWD’s or a sponsor’s marketing purposes. Your Information may be used to contact you for winner notification, prize delivery confirmation, or other related purposes and/or in accordance with this Policy. Your entry in the Promotion may also result in your being added to our mailing lists as well as those of our promotional partners associated with the contest or sweepstakes. In the event that you win a contest or sweepstakes, your acceptance of a prize may require you (unless prohibited by law) to allow us to post publicly some of your information on our website such as on a winners page. In some instances, a third party advertiser or sponsor may operate or host a Promotion on our through our website or service and collect your information. In those cases, where we are not the sponsor or operator of the Promotion, we have no control over the information collected and you should review the official rules as well as the advertiser’s or sponsor’s privacy policy applicable to the Promotion before participating.

Log Data, Cookies, and Web Beacons

When you browse certain portions of the Service, TWD and/or service providers acting on our behalf (such as Google Analytics and/or our third party advertisers) use server log files and automated data collection tools such as cookies and web beacons (collectively, “Log Data”) when you access or use our Service. We tie the information gathered by these means to our customers’ personally identifiable information. Log Data automatically tracks and collects certain technical information that your browser sends to our Service such as your IP address, browser type, browser language, referring and exit pages, URLs, platform type, the number of clicks, domain names, landing pages, clickstream data, pages viewed and the order of those pages viewed, the amount of time spent on particular pages, and the date and time of activity on our Service and other similar information (collectively “Technical Information”). In some cases, we associate this Technical Information with your user ID number and may also share such information with third party service providers assisting us with the foregoing and with our advertisers. For example, some of this information may be collected and used so that when you visit the Service again, it will recognize you and serve advertisements and other information appropriate to your interests. A web beacon is an electronic image that may be used on a website or in an email to track website usage or to track whether an email has been opened and/or acted on. We employ web beacons or similar technologies in our Service, in emails, and in other media for a variety of reasons such as allowing us to: (i) count visits; (ii) deliver cookies; (iii) determine if a certain webpage was visited; (iv) determine whether a certain email was opened; (v) advertise more effectively by tracking the use of our Service to serve targeted advertisements; and (vi) identify the source of a new software installation. Third party advertisers may use web beacons in conjunction with our Service in order to collect and use data regarding advertisement performance and/or your interests for the purpose of delivering relevant advertising to you. Please note that third parties’s web beacon practices are subject to their own policies.

TWD may use the information that we collect through your use of the Service for a variety of purposes, primarily related to providing and improving the quality of our Service. For example, we may use the information we collect in the following ways:

  2. Notifying you of products, services, features, enhancements, promotions, loyalty and rewards programs, updates to the Service, and updates to the Terms of Service and Privacy Policy;

Sharing Your Information

We will disclose any information about you to government or law enforcement officials or private parties as we (in our sole discretion) believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas) to protect the property and rights of TWD or any third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical, or legally actionable.

We may employ third party companies and individuals to facilitate the Service, to provide the Service on our behalf, or to assist us in analyzing how the Service is used including payment processing, data analysis, email delivery, hosting services, customer service, and to assist us in our marketing efforts. These third parties have access to your information only to perform these tasks on our behalf and may not use your information for any other purpose. We may also provide your information to our business partners or other trusted entities for the purpose of providing you with information on goods or services that we believe would be of interest to you. If you do not wish to have this information shared please do not use our Service. We do not actively share your Personal Information with third party advertisers for their direct marketing purposes unless you give us your consent. We may share aggregate or anonymous information about you (including IP Addresses, MAC Addresses for mobile devices, and mobile device IDs) to develop targeted advertising in the Service and on websites of advertisers, publishers, business partners, sponsors, and other third parties. We may also allow advertisers to collect these types of information within the Service and they may share it with us. Advertisers may collect this information through the use of tracking technologies like browser cookies and web beacons. The information collected may be used to offer you targeted ad selection and delivery in order to personalize your user experience by ensuring that advertisements for products and services that you see will appeal to you. Our collection, use, and disclosure of anonymous or aggregated information are not subject to any of the restrictions in this Privacy Policy.

Business Transfer, Sale, or Merger

In the event that TWD undergoes a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer all of your information including Personal Information to the successor organization through such a transition.

Content that You Submit or Communicate Using the Service

We may allow you to submit and communicate audio and video content, text, links, and other content (“User Content”). User Content that you submit to us or communicate using the Service (including any Personal Information included in your User Content) becomes publicly available and can be seen, collected, and used by others. Once made public, User Content cannot be made private again. In addition, User Content you communicate using the Service may be recorded, stored, copied, and/or retransmitted by TWD including but not limited to audio or video content submitted to us. You should not submit or communicate any content using the Service that you do not want to be seen, collected, or used by others.

In the process of posting User Content, you may be asked to provide some personally identifying information such as your name, address, email address, a password, and other documentation. You may also be asked to provide such information in order to use certain features of the Service.

We keep a record of the information that you provide including your Personal Information. That information may be linked in our records to other information you provide including User Content. We will not publicly post your name or other Personal Information, and we will not provide such information to our advertisers or business partners without your permission. However, we may disclose your Personal Information and documentation that you provide under some limited circumstances as set forth below (“Permitted Disclosures of Personal Information”).

Usage Information — Collection and Use by Third Parties

We allow other companies to display advertisements using the Service. These companies use various technologies to deliver the advertisements that you see using the Service directly within your browser. In doing so, they may automatically receive your IP address. Other companies that place advertising using the Service may have the ability to use cookies and/or web beacons to collect information including information about your usage of the Service. We do not control the processes that advertisers use to collect information. However, IP addresses, cookies, and web beacons alone generally cannot be used to identify individuals, only machines. Therefore, advertisers and others whose advertisements or content may be provided through the Service generally do not know who you are unless you provide additional information to them by responding to an advertisement, by entering into an agreement with them, or by some other means.

TWD implements reasonable measures to protect the security of your information from unauthorized access and against loss, misuse or alteration by third parties. We are committed to protecting customer information.

Although we take reasonable precautions against possible security breaches of our Service and our customer databases and records, no website or internet transmission is completely secure and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We do not warrant or represent that your Account or any of your Personal Information or User Content will be protected against loss, misuse, or alteration by third parties. Children’s Privacy

Our Service is not directed to children, and all users of the Service must confirm that they are at least twenty-one (21) years old. We do not knowingly collect or solicit Personal Information from those who we actually know are under 21, and no part of our Service is designed to attract anyone under 21. In the event that we become aware that anyone under the age of 21 is using the Service, his/her access to the Service will be terminated.

International Users

If you are located outside of the United States and access the Service, please understand that the data and Personal Information that you choose to provide to us will be transferred to and stored on servers in the United States or other countries. The data protection and other laws of the United States and/or other countries might not be as comprehensive as those in your country. By submitting your data and/or using our Service, you consent to the transfer, storage, and processing of your data in and to the United States.

Third Party Links

The Service may contain links to other websites and online services (“Linked Sites”). The fact that we link to a third party website or service is not an endorsement or representation of our affiliation with that third party, nor is it an endorsement of their privacy policies or practices. You acknowledge and agree that we are not responsible for the privacy practices or the content of such Linked Sites and that this Privacy Policy does not apply to such Linked Sites. If you have any questions about how these Linked Sites use your information, you should review their policies and contact them directly.

Opt-In and Opt-Out Policy

We will not share your Personal Information in ways other than as described in this Privacy Policy unless you specifically elect to make your Personal Information available to third parties by selecting to “opt-in” in various places on the Service. Your “opt-in” elections will not, however, require us to share your Personal Information with any third party. Permitted Disclosures of Personal Information

TWD will not disclose any Personal Information that it collects or obtains except: (i) as described in the Terms of Service or this Privacy Policy; (ii) after obtaining your permission for a specific use or disclosure; (iii) if we are required to do so in order to comply with any valid legal process or governmental request (such as a court order, search warrant, subpoena, civil discovery request, or statutory requirement); (iv) as required to protect our property, safety, or operations, or the property or safety of others; (v) to a business that acquires TWD or the assets of TWD in connection with which such information has been collected or used; or (vi) as otherwise required by law.

Account Deactivation, Termination, or Deletion

You may request that we deactivate, terminate, or delete your Account by logging into that Account and indicating that you wish to delete that Account. We will make commercially reasonable efforts to respond to your request within thirty (30) days. Please note that we may be unable to process your request if you do not log into the Account that you want to be removed.

Please be aware that even after your Account is removed, some or all of your information may still remain visible to others including (but not limited to) any information that has been: (i) incorporated into others’ User Content; (ii) copied, stored, shared, or disseminated by you or other users; or (iii) posted on a third party platform. We may (but are not obligated to) retain backup copies of your information including your Personal Information on our servers or databases (and/or any authorized third party servers or databases that we use). Such information may be disclosed pursuant to this Policy regardless of whether your Account is removed. Any third party platform or SNS that you use to access the Services may also retain backup copies of your information even after your Account is removed, and that information may be used and/or disclosed in accordance with their privacy policy.

Right to Access

Users in certain jurisdictions have a right to access Personal Information that we hold about themselves. Your right of access can be exercised in accordance with applicable law. Your California Privacy Rights

California residents have the right to receive: (i) information identifying any third party company/companies to whom TWD may have disclosed (within the previous calendar year) Personal Information pertaining to you and your family for that company’s / those companies’ direct marketing purposes; and (ii) a description of the categories of Personal Information disclosed. If you are a California resident and you wish to obtain such information, submit a request to legal@theworstdrug.com with “Request for California Privacy Information” as the subject line and in the body of your message. Please be aware that not all information sharing is covered by requirements and only information on covered sharing will be included in our response. Please also note that under California law, a business is required to respond to such a customer request only once during any calendar year.
